Citizenship: Millions of Americans Eligible for Canadian Amid Law Change

A new Canadian law allows millions of Americans to qualify for dual citizenship. This change took effect on December 15 and has already prompted a surge in applications.

As of early Tuesday, 1,480 Americans confirmed their citizenship by descent from December 15 to January 31. Immigration attorneys report handling up to 20 consultations per day for citizenship cases since the law’s implementation.

The new law enables Canadian citizenship to be passed down to anyone born before a certain date who can prove they have a Canadian ancestor. The application fee is set at 75 Canadian dollars ($55), with processing times estimated at around 10 months.

Last year, approximately 24,500 Americans gained dual U.S.-Canada citizenship. Many cite political dissatisfaction and job opportunities as driving factors behind their applications. Michelle Cunha expressed her frustrations, stating she has put in her best effort for 30 years to make the United States a place of freedom and equality.

Some Canadians have raised concerns about Americans seeking citizenship without strong ties to Canada. Amandeep Hayer emphasized, “You are Canadian, and you’re considered to be one your whole life.” This sentiment reflects the mixed feelings surrounding the influx of applicants.

The rise in applications comes amid broader discussions about birthright citizenship in the U.S., particularly with ongoing Supreme Court cases like Trump v. Barbara. The Foreign Account Tax Compliance Act (FATCA) has also complicated matters for U.S. citizens living abroad.

Renouncing U.S. citizenship can simplify administrative tasks for expatriates. However, experts caution that this move does not guarantee protection against potential political issues back home—”Renouncing your US citizenship is not a guarantee that you won’t end up being ‘part of a dictatorship’,” noted an anonymous source.

With an estimated cost of $6,500 for legal assistance in applying for Canadian citizenship, many are weighing their options carefully. The next steps for these applicants remain uncertain as they navigate the complexities of immigration law.
